TERMS OF DESIGN

Studio Hours & Correspondence

Kiki Co Creative operates Monday through Friday during standard business hours. To maintain creativity and efficiency, weekends and holidays are typically reserved for personal time.

Most communication will occur via email to ensure all project details are documented and easy to reference. Calls may be scheduled when necessary. For quick updates, text communication is available.

Payment Schedule

All payments are processed via PayPal invoice.

Standard Orders

• A 25% non-refundable deposit is required to secure the project.

• 50% of the remaining balance is due at the start of the design process.

• The final 50% is due before final file delivery (for branding) or website launch.

Immediate Start & A La Carte Orders

• Rush/Immediate Start Projects: 50% is due upfront, with the remaining 50% due before launch.

• Site Updates: Full payment is required before updates are made.

Late invoices (over 7 days past due) will incur a $50 weekly late fee until paid. Final files and tutorials will not be delivered until all outstanding balances are settled.

Refund Policy

Due to the custom nature of design work, refunds are not issued. If a project is canceled before work begins, refund requests must be submitted within 7 days of payment. After this period, all payments are non-refundable.

If work has already begun, the client is responsible for all completed work, billed at $175 per hour. In lieu of a refund, a design credit valid for one year may be offered. Any applicable refunds will be processed within 30 days via Paypal.

Revision Policy

Clients are entitled to three rounds of revisions per design stage (e.g., logo or webpage). Additional revisions will be billed at $55 per round.

Post-Launch Edits

Edits requested after launch will be quoted on a case-by-case basis.

Turnaround Time

Timelines vary depending on project complexity, revisions, and client responsiveness. Most projects are completed within 4-8 weeks, but an estimated timeline will be provided upon booking.

Design Fees & Pricing

Clients are responsible for additional fees such as:

• Squarespace Website Hosting: Typically $23-$36/month

• Domain Registration: Typically $10-$20/year

• Any third-party integrations or tools

Please note that all fees associated with using Squarespace as your website platform are your responsibility.

Pause Clause

If a client becomes unresponsive, the project will be placed on hold. It is the client’s responsibility to maintain communication and provide necessary materials in a timely manner. Kiki Co Creative will not be responsible for sending multiple follow-ups or reminders to keep the project on track.

• Changes made to the Kiki Co template during the pause will incur additional fees.

• Projects paused for 90+ days will require a $175 restart fee.

• Projects paused for 1 year or more will be considered abandoned, and all payments will be forfeited.

Client Responsibility for Accuracy

Clients are responsible for reviewing all website content, contact details, and form functionality before and after launch. Kiki Co Creative is not liable for errors that go unreported post-launch. Any necessary corrections requested after launch will be billed at standard rates.

Error Correction Policy

If Kiki Co Creative is responsible for an error, corrections will be made at no additional cost if reported within 14 days of launch. After this period, corrections will be considered post-launch edits and billed accordingly. Errors do not entitle the client to additional compensation beyond corrections or, in rare cases, a partial refund at our discretion.

Permissions & Use

Clients must have proper licenses or permissions for all provided text, images, and design elements. Kiki Co Creative is not liable for copyright infringement or misuse of client-provided materials.

Font Licensing

Any fonts used in branding or web design may require a commercial license for continued use. Clients are responsible for purchasing their own font licenses if needed. Kiki Co Creative will provide links to purchase the necessary font files but will not distribute or include licensed fonts directly in project deliverables

Confidentiality & Account Access

All communication and materials exchanged between Kiki Co Creative and the client are confidential and may not be shared without written consent. During the project, temporary access to client accounts may be required, but all login credentials will be handled securely and never shared.

Site Content

As the client, you agree to provide all necessary page copy and images, which will be integrated seamlessly into the design. Please ensure that all content is finalized and ready for use prior to the start of the project to keep the process smooth and efficient.

Printed Materials Disclaimer

Kiki Co Creative is not responsible for printing quality and does not offer refunds for printed materials.

Design Credit & Rights to Work

Clients receive full rights to their logo and branding materials. However, a designer credit linking to Kiki Co Creative must remain visible on all websites designed or developed unless an exemption is agreed upon in writing.

Limitation of Liability

Kiki Co Creative is not liable for any indirect, incidental, or consequential damages, including but not limited to lost profits, lost business opportunities, or reputational harm arising from the use of our services. While we strive for accuracy, clients are responsible for verifying all content before and after launch.

Dispute Resolution

In the event of a dispute, both parties agree to attempt resolution through mediation before taking legal action. Any legal claims must be filed in the jurisdiction where Kiki Co Creative is registered.

Agreement

By submitting a project request and paying the deposit, you confirm that you have read, understood, and agreed to these design terms.
